TERMS AND CONDITIONs.
All drivers must be 21 years old and have held a FULL driving license for minimum 3 years.
All drivers must sign the rental agreement and show their original driving license on delivery.
No smoking in the car. If the car smells of smoke on collection the renter agrees to pay 4,000 Baht to cover the replacement of the aircon filter and cleaning the car’s seats, carpets & headliner.
The car is delivered with a full tank of fuel and must be returned with a full tank. If the vehicle is returned without a full tank the renter agrees to pay for the fuel at the rate detailed on the rental agreement.
If the Renter allows the wrong fuel to be put in the vehicle the renter will be responsible for the cost of fixing the vehicle.
One rental day is a period of 24 hours. If the vehicle is not returned or made available by the specified time and date agreed on the rental agreement, the Renter will be given 30 minutes grace period after which each hour (or part thereof) will be charged at one-third (1/3) of the daily rate, up to 3 hours which shall constitute a full days hire.
All penalties relating to parking & traffic offenses are the responsibility of the renter. If ECR pays the penalty on behalf of the renter, the renter agrees to reimburse ECR for the full amount plus an administration fee of Baht 250 per penalty.
If the vehicle is excessively dirty when it is returned to ECR and the condition of the car can not be assessed due to dirt and dust, the deposit will not be returned to the renter until the vehicle has been cleaned and inspected. If the renter does not have a Thai bank account the deposit will be re-paid via PayPal within 48 hours. If the renter does not have a PayPal account the amount will be sent to the renter’s foreign bank account BUT all bank costs and charges plus an admin fee of 250 Baht will be for the renter’s account.
If any damage is discovered after cleaning, photographs of the damage will be emailed to the renter within 48 hours and the cost of repairs will be deducted form the deposit. The balance will be returned by PayPal.
Please note the rental rate is based on driving in the area South of Bangkok (including Bangkok) and North of Chumpon. If the Renter wants to travel further afield (eg Phuket or Chiang Mai) they must let ECR know BEFORE delivery of the vehicle. ECR has the right to refuse travel outside the above mentioned area if it is requested AFTER the car has been delivered.
All cars are fitted with a GPS tracker. ECR will be notified if a car travels outside of the agreed area. If a car is taken outside the agreed area without written permission the renter agrees to pay 3,000 Baht penalty.
In the event of an accident the Renter must immediately inform the police and ECR.
If emergency roadside assistance is required due to breakdown the hirer can telephone 0861669880 or 0982755966
If the Renter loses the car key or locks the key inside the vehicle (and the vehicle is located within 25km of Hua Hin) ECR will arrange to unlock the vehicle with the spare key. Cost 500 Baht during office hours and 1,500 Baht after office hours. If the vehicle is located a long way from Hua Hin ECR will send out the spare key by Courier Service NEXT DAY delivery at the cost of Baht 1,500. The hirer is responsible for the cost of any lost Key.
The renter shall NOT permit the vehicle to be used to carry paying customers, sublet or hire the vehicle, race, rally or tow another vehicle or transport more than the number of passengers specified. All cars are licensed and insured to cary 5 passengers except Toyota Fortuner’s which can carry 7 passengers.
If the insurance is rejected by the insurance company due to improper actions by the renter (e.g. driving while intoxicated by alcohol or other drugs) the renter accepts that the vehicle is hired at the renter’s own risk in respect of loss or damage to the vehicle and consequential losses incurred by ECR. The hirer accepts by signing the rental agreement that he or she may be liable to ECR for damage to or loss of the vehicle and other consequential losses. If insurance is rejected the renter accepts by signing the rental agreement that he or she has no insurance cover under this agreement in respect of any damage, injury, or loss caused to any person or property.
The renter acknowledges that he or she is liable to pay the non-waiverable excess of 5,000 Baht in the event of an accident or damage to the vehicle. The non-waiverable excess applies to each individual accident or each separate occurrence of damage to the car. If the car is damaged multiple times in separate unrelated accidents or incidents then the insurance excess is 5,000 Baht per accident.
If the accident is the fault of the other vehicle and this is verified by the police and insurance assessors then the renter does not lose their deposit.
ECR have the right to terminate this agreement and take immediate possession of the vehicle if the renter fails to comply with any of the terms of this agreement or if the vehicle is damaged. The termination of this agreement shall be without prejudice to the other rights of ECR and the rights of the renter .
On long term rentals (over 3 weeks) the Renter shall ensure that the water in the radiator is maintained at the proper level, the oil in the vehicle is maintained at the proper level and the tires are maintained at their proper pressure.
